2012 NFL Mock Draft: Orson Charles Has Had a Very Tough Offseason

After the 2011 season, Orson Charles made the decision to forgo his senior season in Athens and declared for the NFL Draft. Not many thought it was a bad decision on his part. Most figured he would go somewhere in the top two rounds as he was one of the top tight end prospects. He was even listed number one on Mike Mayock's board. It was clear that if he stayed in Athens, he probably wouldn't be able to make a huge leap on anybody's draft board.

The off-season hasn't exactly been what dreams are made of -- more like nightmares -- for Charles. First he made the decision not to run at the combine. In itself, that's not a big deal. But if you are going to run, why not do it indoors? Charles instead decided to run at Georgia's pro day. It probably would have benefited him if he knew there were going to be gusting winds of 25-30 mph the entire day. You live and you learn. Charles disappointed with his 40 time at Georgia's pro day posting a 4.75 when many were expecting him to run in the 4.5s. A 40-time doesn't dictate whether you will be a good pro or not but it can help immensely when we are talking about your draft position.

Prior to today, there was a lot of talk about Charles dropping down draft boards. Then this morning Charles was pulled over for DUI and a minimum speed violation. I couldn't make up a worse story if I tried. Charles kept his nose clean at Georgia but he's only been a "free" man for about three months and then this happens. It will definitely give NFL teams a pause before pulling the trigger on him.

The NFL is littered with guys with questionable characters and run-ins with the law that play high level football. Fair or not, Ray Lewis and Michael Vick are the first names that comes to mind. They have turned out pretty good on the football field. Another tight end that had some off the field issues prior to the draft was Brandon Pettigrew. He was charged with assaulting a police officer but that was a year prior to him entering the NFL Draft. Ultimately he was chosen with the 20th overall pick. Aaron Hernandez of Florida was another guy who had a bad reputation and it came to a head before the NFL draft when he told teams he failed multiple tests for marijuana while at Florida. Hernandez dropped from being a possible first round pick all the way to the fourth round. Is that the kind of fall that we see for Orson Charles? Only time will tell.

London mayor: your ideas for policy on powers and responsibilities | Dave Hill

What does the mayor actually do? Londoners give it some thought. Link to this video

The job of London mayor is sometimes mocked as being big on profile but low on power. The office has acquired greater clout over the years, but that characterisation is still not too far wrong. It brings its holder attention, glamour, political symbolism and a fine view of Tower Bridge, but limited levers for running the city or moulding how it evolves. Yet that attention is a platform from which to exert influence, and the use of those levers can have large effects. Who the mayor is matters, and how he or she goes about their business matters too.

Tony Travers, the distinguished London School of Economics local government expert, wrote a book about politics in the capital, subtitled Governing An Ungovernable City. "There have been conflicts between the needs of neighbourhoods and the requirements of the city as whole ever since the capital sprawled beyond the boundaries of the City of London," Travers writes.

Under the mayoral system a similar tension exists between London's 32 borough councils and City Hall. Their powers differ yet they abut and overlap: the mayor is boss of London's big roads, the boroughs of its little ones; the boroughs collect council tax but mayors can ? and do ? top up their bills; the boroughs determine planning applications, but the mayor can block their decisions or appropriate them.

Ken Livingstone's critics said he centralised too much, especially over house building. Boris Johnson's complain that his "working with" the boroughs means Tory ones indulging their nimbyism. The Liberal Democrat London Assembly member Mike Tuffrey, like Livingstone a veteran of the Greater London Council, has espoused devolving more to neighbourhood level ("to rediscover London as a collection of villages") combined with a much more ambitious, strategic Greater London Authority, led by a mayor armed (thanks to the coalition) with more direct control over housing, planning and economic development.

What balance of powers should our model mayor foster? What new ones, if any, should she or he seek? What about health and education? And what about money? The bulk of the GLA group's budgets come from central government, and have to be argued for. London can seem spoiled compared with the rest of England, yet though the capital receives about the same money as Wales, it contains a lot more people.

Does London get enough, or should its mayor start thinking less about endless growth and more about taking better care of what ? and who ? it's got and where the limits of its expansion might lie? The model mayor needs to have a broad vision of the capital's future. Both real mayors so far have been bullish Londonists, but should an argument be made that London would be better improved if Manchester, Glasgow and Cardiff shared more of the burdens as well as the rewards of being engines of the UK economy?

Those are some of the big themes, but there are crucial smaller ones too. In a time of financial squeeze, Johnson has pioneered commercial sponsorship deals to support transport projects, but how much corporate branding do we want intruding into public spaces and do Londoners get the best of such deals? The City of London is a place of fabulous wealth. Should the mayor demand that it shares it with London, the greater city, a little more? Accountability and transparency matter too, with Livingstone accused of being too controlling and dependent on a close coterie and Johnson of being slapdash and evasive.

And then there's the public character of the mayor. Both Johnson and Livingstone have reputations for being outspoken, including on subjects that aren't directly, if at all, their responsibility. Do London mayors have to be big personalities, or would we sooner have someone quieter for a while? I'll shut up now. Over to you.

In recent years the Mayor has gained new powers and responsibility which require us to re-examine the structure of City Hall and how decisions are made.
Using the new Mayor's Office for Policing and Crime as a template, organisations such as transport for London and LFEPA should be brought into City Hall and headed by Deputy Mayors with meaningful powers, moving us away from the current honorific titles whose holders have differing, and in some cases, no powers beyond advising the Mayor.
Appointment of these Deputies should be subject to a binding majority vote by the London Assembly - if a majority of Assembly Members say nominee X shouldn't get the job, they don't get the job.

Frankly, if London was offered UDI, I'd go for it tomorrow. Let's secede.
More seriously - we've got to start thinking of the UK as five nations - Scotland, Wales, Northern Ireland, England and London. Full devolution for London would mean better decision-making for the capital and also stop the resentment felt, particularly in other parts of England, towards the capital. It might also be a prompt for the rest of England to stop bellyaching and get its act together.
If we can't have full devolution, let's have the NHS. Let's develop a distinctive city health service, apart from the privatised vision espoused by the Tories and Labour in England.
And inside the city, let's break up the boroughs. Fewer than a third of people bother to vote for them, and they're often rancid little empires which make the City of London look democratic. Let's have five super-boroughs, each with a bit of the centre of town and stretching out to the suburbs, with their own mayor, and devolve street scene and other initiatives down to neighbourhood councils. (That's an idea espoused by one K Livingstone, btw).

Hello SC. Thanks for those ideas. Some questions. If your super boroughs stretched from the centre to the suburbs, would they truly represent natural areas of London? If not, would that matter? How much control over streets would neighbourhood councils have? I have a vague recollection of K. Livingstone talking about devolving some powers to a very local level but nothing more. Got any links?

Could the mayor pay for London Underground staff to be equipped with cattle prods to move on the gormless who stop at the bottom of the escalators for no apparent reason?
Also could we enact a bylaw to punish queue jumpers with an hour or two in the stocks, or some such punishment?

A lot of people have fond memories of the GLC and its elections were seen to matter to the lives of ordinary Londoners in a way that's not really the case with the Greater London Authority.
So I don't think recreating the GLC is a bad thing!
Like SuperClive, I think the NHS in London should be under City Hall's control so that Londoners can shape their own healthcare system. I'd ask like to see the Mayor take over OFSTED in London so that he could drive up education standards.
It's pointless having a Mayor responsible for finding people jobs if he/she can't shape their suitability for employment at their earliest possible stage of their development.

The one and only time I attended a meeting of the board of the London Development Agency I left asking myself why on Earth it was at arms length from City Hall. What was the point? I didn't mention this to other people at the time in case they laughed. Times have changed, and it looks like a good thing too. When I talked to Mike Tuffrey about these issues I liked his idea of a combination of a strong, strategic centre and very local decision-making bodies with proper powers. Incidentally, I'm sure I have an album by DevoMax somewhere in my vinyl basement.

It would be great if you could look at the role which the Mayor plays in public health, You'll no doubt be aware that with or without the legislative changes being put through via the health bill, public health will be delivered by local authorities. In my view this is absolutely the right place for public health to be and offers a great deal of opportunity for cross-policy collaboration,
In London, 3% of the LA public health budget is being top-sliced post April 2013 for London-wide approaches to issues such as childhood obesity that can benefit from a collaborative approach.
It would be great if your manifesto can support this approach whomever the next Mayor is - the London Health Improvement Board which is already delivering the shadow version of this approach is a great organisation and one which could have a fantastic benefit on London.
Londonwide collaboration across transport and health has hugely beneficial implications.

Hi. It's quite a mystery why the mayor has an adviser on health and families paid ?127,000 a year despite his having no powers over general health policy. Thanks for your idea, which I'll do a bit of homework on. There does seem to be quite a widespread view that Londonwide government should be in charge of Londonwide health.

A strong argument can be made that the Mayor doesn't actually have tremendous power (and that the overlap between the boroughs, the Mayor and central government can be confusing), but the danger here is that we let the office holder 'off the hook,' as it were. The truth is that Mayoral strategies and areas of policy responsibility are not always given the effort and attention they deserve.
Housing is an excellent example of this, particularly under Boris, though Ken is not guilt-free either. The Mayor has new powers over housebuilding in the capital, but there is little reason to think that this will make a huge difference to the outcome - even before, fewer houses have been built than could have been. Similarly, the proportional requirement for 'affordable housing' is lower than it should be, and seems to be open to change at the whim of the office holder (and few people are naive about the fact that so much 'affordable' housing is actually unaffordable). Increasing the proportion would be a fantastic way to ensure the development and maintenance of the 'mixed communities' which every politician says they support. Everyone knows that London is in the midst of a housing crisis, and the Mayor can do something about it.
Following elliebesley's point, the Mayor's Health Inequalities Strategy is widely thought to be a pretty good document... now if only it would serve as the basis for policy! The research we've done suggests that, far from being the starting point for everything the GLA does, it is often simply put at the bottom of the priority in all the offices of the GLA. Imagine how influential the Health Inequalities Strategy could be if the vastTransport for London took it seriously - and that is but one of the functional bodies.
What we ought to be calling for is a Mayor who actually enacts their policies, and who takes their responsibility seriously. This is perhaps one danger of the kind of personality politics which is so common in London. On the other hand, the force of will of a big personality might be exactly the kind of thing needed to make sure that the GLA group responds to the demands of voters.

I'm very struck by your point about the mayor's health inequalities strategy and its near-invisibility (I confess I haven't read it). We'll be looking at housing separately next week, but for now you and others might be interested by the proposals in Shelter's campaign.

Something needs to be done with the councils. There's a complete lack of joined up thinking within the councils themselves, let alone between neighbouring borough. An example of this would be Crystal Palace, which sits on the border of five boroughs and, as such, is seemingly pulled in five different directions. Whether we're abolishing them, merging them, I don't know. However, they've got to go.
As Superclive said, they've built little empires. I live in Beckenham, which is covered by Bromley council, and they hear what they want. The Conservatives have 53 seats out of 60, they do what they want. If they were so NIMBYist, the head of the development committee would live up to his pledge to defend our Metropolitan Open Land, rather than recommending and voting for the development of a private cricket stadium, that will hardly ever be used, and 48 new houses on a site that is currently used heavily by local kids who have grown up in a town that has been carved up by developers for their own gain? If that's NIMBYism, I need a new lexicon of terms.
In short, the Mayor needs the power to keep community assets in the community.

Hello and thanks. For a (north) east Londoner I know Crystal Palace and bits of Bromley fairly well. The mayor has powers to intervene in borough planning determinations, though these have to be of "strategic importance." The issue you're concerned with probably wouldn't fall into that definition. Perhaps the mayor's powers to intervene should be broadened?

Properly co-ordinated strategies on social housing? That would certainly be a priority in my book, as somebody who used to work in the field a decade back (albeit outside London); as somebody mentioned, the Mayor has new powers in this area but I don't see much action coming from that quarter, whatever the outcome at the elections. The current situation just has too many layers to it, too many committees; give the super boroughs the freedom to do what is necessary, light the blue touch paper & step back.
What powers would they not have? Sadly it rather looks like policing may be taken out of everybody's control, but that is possibly a separate discussion.

If you mean cross-border co-operation on social housing (and homelessness) that sounds good, though there's already so much tension between boroughs over importing/exporting homeless and needy people. Don't want to devour your day, but can you be more specific about what you have in mind?

A lot of posters seem to be more concerned with devolution of national powers to the mayoral office, rather than the balance of powers between local councils and the mayoral office. I think this is a reflection that cities are fundamentally different places from the countryside to manage. Perhaps then, at the highest level of government, we should be looking to split matters between those managing cities, and those managing surrounding areas and countryside?
This would of course require a fundamental rethink of how we structure our politics at all levels. Perhaps though, it would better reflect the "natural areas" you have spoken of. Cities have grown massively over the last 50 years, and we haven't restructured our politics so fundamentally to match that change yet.

Do we need boroughs at all?
Just have the equivalent of parish councils for individual communities and then give all the rest of the powers and responsibilties to the directly elected London Assembly. There'd be no conflicts between the boroughs and TfL, no buck passing between councils, no petty fiefdoms, no passing on hidden costs such as witha the expansion of the cycle hire scheme. There would surely be savings from removing all the duplication of effort in terms of branding and propaganda if nothing else.
I live in Newham. As someone who doesn't vote Labour I don't have a voice at borough level.

Newham is indeed a big red wall politically. But those urban parish councils might get completely steamrolled unless they had quite a lot of power. And if they were small, how much should they have?

Russia probes 'arson' deaths of 7 children

Police opened a murder investigation on Friday after alleged arson killed a couple and seven children during a house fire in a village near the central Russian city of Perm.

"According to the preliminary results of an examination of the scene, the cause of the fire was arson," the Russian state investigations committee said on its website

"As a result, the building was filled with smoke. A 34-year-old man, his wife and seven children aged from four to 13 years died from carbon monoxide poisoning," the statement said, adding that an investigation to confirm the causes of the fire in the village of Mokhovoye was continuing.

"All the circumstances of what happened are being established, including the reasons leading to the tragedy," the statement said.

Five more children also died in two separate house fires in the provincial towns of Pugachev and Khvalynsk in the Saratov region overnight, Russian agency RIA Novosti reported without indicating what caused the blazes.

The mother of three of the children also died in one of the fires.

Canadian Natural posts Q4 profit; raises dividend

(Reuters) - Canadian Natural Resources Ltd posted a fourth-quarter profit, helped by higher production, and Canada's largest independent oil explorer increased its quarterly dividend by 17 percent.

The company, which increased the dividend to 10.5 Canadian cents per share, said it was on track to restart operations at its Horizon oil sands project in Alberta.

Last month, the project was shut due to problems with a fractionator unit. The company had earlier said the plant will not return to full output until mid- to late March.

The extended outage forced it to cut its 2012 production target for the operation to 93,000-103,000 barrels a day from the previous forecast of 105,000-115,000 bpd.

On Thursday, the company said it reduced its planned natural gas capital expenditure for the year by $170 million, which is expected to slash natural gas output by about 20 million cubic feet per day (MMcf/d) and 460 barrels of liquids per day in the year.

Canadian Natural, which has hedged 40 percent of its natural gas production for 2012, expects to produce an average of 1,247 to 1,297 MMcf/d of natural gas in the year.

FOURTH QUARTER BEATS ESTIMATES

Canadian Natural, which operates in Canada, the North Sea and offshore West Africa, earned C$832 million ($830.13 million), or 76 Canadian cents a share, compared with a net loss of C$309 million, or 28 Canadian cents a share, last year.

Excluding unusual items, the company earned 88 cents a share, ahead of analysts' expectations of 86 Canadian cents a share, according to Thomson Reuters I/B/E/S.

Cash flow, a glimpse into the company's ability to fund future operations, was up 31 percent at C$2.16 billion, or C$1.96 a share.

Production rose 2 percent to 657,599 barrels of oil equivalent per day.

The company's shares closed at C$35.14 on Wednesday on the Toronto Stock Exchange. The stock has fallen 8 percent since the start of the year.

Inspired by the easiness of spending trips with his family in a 78 square foot Airstream, housing developer Patrick Kennedy decided to build the smallest legal apartment you can build in California. Kennedy envisions his SmartSpaces as "a larger and hipper version of LEGO blocks."

While the the studio isn't currently occupied, an MIT student did spend 3 weeks in the humble abode to try it out. The current space isn't perfect, but Kennedy has used feedback from the student and his team to make version 2.0 better. Property features include a table that turns into a bench that doubles as a bed "if you've had a friend over who's had too much to drink," and the building materials, which were really important since the dweller would be in such close contact with every finish. China pulls workers from Syria, seeks Libya compensation

BEIJING (Reuters) - China is bringing workers home from Syria, its Commerce Minister said on Wednesday, in an apparent attempt to avoid a repeat of last year's eleventh-hour rescue of Chinese nationals from Libya when violence engulfed the country.

Only about 100 Chinese workers will be left behind to guard work camps and equipment, Minister Chen Deming said, without giving figures for the total number of Chinese citizens or projects in Syria.

"The Chinese government and ministries must seriously undertake the protection of Chinese firms' production and projects overseas, and the protection of the lives of Chinese citizens overseas, especially engineering teams," Chen told reporters.

Beijing sent an envoy to Damascus this week, even as closed-door meetings were held at the United Nations to discuss a U.S.-drafted resolution urging an end to the Syrian government's increasingly lethal crackdown on a year-long revolt.

China joined Russia to veto previous U.N. resolutions on Syria in October and February, moves which drew fierce international condemnation.

China was caught off guard last year when a civil war erupted in Libya. Nearly 36,000 of its nationals exited the country, some by hastily chartered ships, while others fled by foot or by bus into Egypt.

Chinese workers were involved in Libyan projects worth $17 billion, Chen said, describing those projects as primarily residential construction projects, in or near Libyan cities.

His remarks represent some of the most detailed comments so far by Beijing officials regarding Chinese interests in Libya.

"The tragedy is that these projects were badly damaged during the instability, the civil war and the foreign intervention," Chen said.

"So we are negotiating with the Libyan government, we hope that the Libyan government can actually begin compensation for these projects in accordance with international norms."

China is evaluating the security situation in Libya, he said, but does not yet deem it safe enough for work on Chinese projects to resume.

China's growing appetite for resources and Chinese firms' competitiveness in overseas road, dam and construction tenders has made its workers more vulnerable to threats.

In January, 29 Chinese workers were kidnapped and one killed by rebels in Sudan, as part of their dispute with the Khartoum government.

In recent years, Chinese workers have also been targeted in Egypt, Niger and Pakistan, among other countries.

I dislike that we have become a starkly divided nation but understand the philosophical underpinnings of many disputed issues. I can?t understand how one mind can believe government intrusion into the personal decisions of citizens is an intolerable restraint on liberty (the conservative credo), yet insist government deny women free choice in their reproductive decisions, gays the right to marry, and suffering patients the right to die. We are a nation of secular laws designed to protect our rights from infringement by others; lawmakers have no authority to criminalize activities simply because they offend religious beliefs. The purest example of faith-based lawmaking is the denial of the right to die, a right I?ve fixated on lately for a number of reasons.

1. As a humanist, I seek to minimize human suffering and believe religion?s approach to modern medicine is inhumane, as well as logically inconsistent. To me, it seems difficult to sustain the argument that medicine cannot be applied to hasten death but can be applied to prolong life. Either God?s plan is sacrosanct or we can use available tools to alter end-of-natural-life timing. While Christian Scientists may be a logically consistent minority (many shun medicine altogether), it seems more likely a rational and loving God would approve humanity?s use of medicine to reduce suffering, whether by curing ills, managing pain, or hastening an imminent and inevitable death.

2.? As a lawyer, faith-based lawmaking infuriates me. Even if we accept the rationality of the Church?s objection to euthanasia, which guides the consciences of many citizens, we are still governed by the Constitution, not the Vatican. Freedom of religion not only guarantees us the right to practice our choice of faith but also freedom from others, even the majority, imposing their faith upon the rest of us. Terminal patients who wish to die with dignity should be permitted to exercise their free will, even if it offends the conscience of others.

3. As a fiscal realist, I see a zero-pain fix to a vexing budget dilemma. As advances in medicine expand the scope of desperate measures available to extend life, the cost of end-of-life care threatens to overwhelm families and government programs?about 30% of all Medicare expenditures are incurred in the final year of life. We cannot afford unlimited medical care for everyone?some rationing is inevitable?but we can minimize rationing by providing a dignified, painless death for those who want to voluntarily abandon expensive treatment options and long-term care.

4. As an observant citizen and amateur philosopher, I believe our focus on economic advancement over the past several decades has led to a diminished role for the elderly and lower quality of life for all. Increased mobility has created distance between extended families, and Social Security and Medicare have institutionalized senior care. My suspense novel, King of Paine, was inspired, in part, by misplaced priorities of the Baby Boomer generation, as animated by this passionately delivered quote from one of my characters, a reclusive doctor who has taken these serious matters into her own hands:

?It?s a breakdown in society. When we think only in terms of dollars and cents, we fail to place value on intangibles you can?t buy. Parents work a lifetime to build and support a family, but where are the children in their twilight years? Money can provide food and medicine, but the end of life shouldn?t be about sustaining a suffering old machine! The end should be a reward for a life worth living. We should be surrounded by our loved ones. We should have a peaceful place to die with dignity and joy and maybe even a little poetry.?

Like Dr. Simone Perlow, I yearn for a social order that improves our elders? quality of life by encouraging family care while practical?centering our lives around family and tradition?but allowing for a graceful exit when only suffering remains.

5. As a recently diagnosed Parkinson?s patient, I want to fill my life with joy and purpose until I can?t. Suicide is an option, in due time (my symptoms are mild), but a friend recently observed that the real danger is waiting too long, until the mind or body is no longer capable of such a benevolent act. If it were legal, my living will would direct my family and doctors to take affirmative steps to end my life (a) at my direction if I can no longer care for myself or (b) per my prior instructions if I can no longer communicate rationally. As the law stands now, I fear someone else?s God will ultimately force me to live as an undignified shell of my former self, a burden on my family and country.

Give me liberty! Give me the right to die when I choose.

France easily sells $10.8 billion in bond auctions

(AP) ? The French treasury says it sold euro8 billion ($10.8 billion) in bonds amid relative calm on financial markets ahead of a two-day summit of European leaders aimed at charting a path back to growth.

On the secondary market, where bonds trade openly after they're issued, the yield, or interest rate, on France's 10-year bonds fell by nearly 0.10 percentage point Thursday to 2.78 percent. That's below the 3 percent level widely considered a benchmark of investor confidence.

Earlier this year, Standard & Poor's downgraded France because of concerns over its economy as well as Europe's ability to get a grip on a debt crisis that's been raging for nearly two years. The decision was widely anticipated so the impact has been fairly muted.

Astronomers rediscover life on Earth -- by looking at the moon

ScienceDaily (Feb. 29, 2012) ? By observing the Moon using ESO's Very Large Telescope, astronomers have found evidence of life in the Universe -- on Earth. Finding life on our home planet may sound like a trivial observation, but the novel approach of an international team may lead to future discoveries of life elsewhere in the Universe. The work is described in a paper to appear in the 1 March 2012 issue of the journal Nature.

"We used a trick called earthshine observation to look at the Earth as if it were an exoplanet," says Michael Sterzik (ESO), lead author of the paper. "The Sun shines on the Earth and this light is reflected back to the surface of the Moon. The lunar surface acts as a giant mirror and reflects the Earth's light back to us -- and this is what we have observed with the VLT."

The astronomers analyse the faint earthshine light to look for indicators, such as certain combinations of gases in Earth's atmosphere [2], that are the telltale signs of organic life. This method establishes Earth as a benchmark for the future search for life on planets beyond our Solar System.

The fingerprints of life, or biosignatures, are hard to find with conventional methods, but the team has pioneered a new approach that is more sensitive. Rather than just looking at how bright the reflected light is in different colours, they also look at the polarisation of the light [3], an approach called spectropolarimetry. By applying this technique to earthshine observed with the VLT, the biosignatures in the reflected light from Earth show up very strongly.

Co-author of the study Stefano Bagnulo (Armagh Observatory, Northern Ireland, United Kingdom) explains the advantages: "The light from a distant exoplanet is overwhelmed by the glare of the host star, so it's very difficult to analyse -- a bit like trying to study a grain of dust beside a powerful light bulb. But the light reflected by a planet is polarised, while the light from the host star is not. So polarimetric techniques help us to pick out the faint reflected light of an exoplanet from the dazzling starlight."

The team studied both the colour and the degree of polarisation of light from Earth after reflection from the Moon, as if the light was coming from an exoplanet. They managed to deduce that Earth's atmosphere is partly cloudy, that part of its surface is covered by oceans and -- crucially -- that there is vegetation present. They could even detect changes in the cloud cover and amount of vegetation at different times as different parts of Earth reflected light towards the Moon.

"Finding life outside the Solar System depends on two things: whether this life exists in the first place, and having the technical capability to detect it," adds co-author Enric Palle (Instituto de Astrofisica de Canarias, Tenerife, Spain). "This work is an important step towards reaching that capability."

"Spectropolarimetry may ultimately tell us if simple plant life -- based on photosynthetic processes -- has emerged elsewhere in the Universe," concludes Sterzik. "But we are certainly not looking for little green men or evidence of intelligent life."

The next generation of telescopes, such as the E-ELT (the European Extremely Large Telescope), may well be able to bring us the extraordinary news that Earth is not alone as a bearer of life in the vastness of space.

India?s Supreme Court today decided to re-schedule the final hearing of the Novartis vs. the Government of India case for 28 March 2012. The hearings were initially scheduled to start today (28 February), but the Mumbai terror attack trial in the Supreme Court has been running later than anticipated, and Justice Aftab Alam, who has been hearing the Mumbai attack case, is also part of the two judge bench that will hear the Novartis case.

The Novartis Supreme Court case is the final act in a legal battle that stretches back six years over India?s future capacity to produce low-cost generic medicines for its people, and for patients in other developing countries. Given the potentially huge ramifications on generic production and the availability of affordable medicines from India, M?decins Sans Frontie?res, along with many other treatment providers, patient groups and affected communities has appealed to Novartis to stop its legal attacks on the ?pharmacy of the developing world.?

Please find below a response to Novatis?s recent argumentation, regarding the impact of their legal proceedings, which relate to the patent that was refused for imatinib mesylate (which Novartis markets as Gleevec).

WHAT NOVARTIS SAYS:
NOVARTIS: Gleevec will continue to be (generically) available under the transition clause in the Indian patent law regardless of the legal outcome of our case.

NOTE: Novartis is referring to the transition clause which is also known as the ?automatic licensing? clause in India?s patent law. This means that Indian companies already producing a generic version of a drug?if this production began before 1 January 2005?do not have to negotiate for a voluntary license or request a compulsory license from the government but can continue to produce the product, provided a ?reasonable royalty? is paid to the patent holder.

BUT if imatinib can still be produced generically ? providing a ?reasonable royalty? is paid ? what?s the concern?
Response from public interest groups:
1. If Novartis does finally manage to obtain a patent in India, by having managed to change the law, production of generic versions of imatinib by companies that do not already produce it may no longer be possible.
2. Even for companies who already produce generic versions of imatinib, there are still many concerns. What a ?reasonable royalty? entails remains very undefined and could potentially increase the price of the generic drug and thus affect its availability. Patient groups also fear that once a patent is granted and thus a stronger right for the patent holder exists, generic producers may become subject to legal actions (infringement suits) by the patent holder.
3. The imatinib mesylate patent application was the first application in India that was rejected on the grounds that ?it is a new form of a known medicine.? The decision of the Supreme Court to reverse this decision could determine how the patent office decides other applications covering new forms of essential medicines. Unlike imatinib, many other drugs may not have been in generic production before 1 January 2005, and therefore Indian producers will not be able to apply the automatic licensing clause.

This limits the generic competition needed to keep prices down. TIMELINE: Novartis?s attack on the pharmacy of the developing world ? KEY DATES
1994 ? India signs the World Trade Organization (WTO)?s Agreement on Trade Related Aspects of Intellectual Property Rights (TRIPS Agreement) which means that it must now start granting patents on medicines no later than 2005.
2003 ? Novartis launches its imatinib mesylate as a blood cancer medicine (brand name: Gleevec) in the US at $2,600 per patient per month. Generic versions of Gleevec soon become available in India for under $200 per patient per month.
2005 ? India changes its patent law to comply with the TRIPS Agreement, and medicines can now be patented. But the law stipulates that only true medical innovations will be granted patents. Section 3(d) of the law specifies that new forms and new uses of known substances cannot be patented, unless they demonstrate a significant increase in efficacy.
2005 ? India?s patent office starts examining patent applications on medicines including Novartis?s patent application for imatinib mesylate.
January 2006 ? Novartis?s patent application on imatinib mesylate (Gleevec) is rejected by an Indian patent office on several grounds, including on Section 3(d) that it is simply a new form of a known substance.
May 2006 ? Novartis files two legal challenges in the Madras High Court. One is to appeal the rejection of the patent. The second is to have Section 3(d) of the Indian Patents Act declared contrary to the TRIPS Agreement and to the Indian Constitution.
December 2006 ? M?decins Sans Fronti?res launches an international petition calling on Novartis to ?Drop the case?. 450,000 people sign on but the company does not back down.
August 2007 ? The Madras High Court rules against Novartis in its case to overturn Section 3(d) in India?s patent law. The Madras High Court also rules that ?efficacy? under Section 3(d) would require Novartis show an increase in therapeutic efficacy. MSF hands over its petition of close to half a million signatures to Novartis in Basel.
August 2007 ? The scientist behind the discovery of imatinib, Brian Druker, writes an opinion piece publicly stating that ?the price at which imatinib has been offered for sale by Novartis around the world has caused me considerable discomfort. Pharmaceutical companies that have invested in the development of medicines should achieve a return on their investments. But this does not mean the abuse of these exclusive rights by excessive prices and seeking patents over minor changes to extend monopoly prices. This goes against the spirit of the patent system and is not justified given the vital investments made by the public sector over decades that make the discovery of these medicines possible.?
June 2009 ? The Intellectual Property Appellate Board which is responsible for hearing appeals on patent applications rejects Novartis?s appeal and confirms that imatinib mesylate does not deserve a patent, on the grounds that the company was unable to show significant increase in (therapeutic) efficacy as required under Section 3(d) of India?s patent law.
August 2009 ? Novartis approaches the Supreme Court of India in a new case ? this time seeking to challenge the interpretation and application of Section 3(d) by Indian courts and patent offices.

Final arguments are due to start before the Supreme Court on 28th March 2012.
